The joint custody, based on parental co-responsibility, is incorporated through Law 15/2005 in the Civil Code. In the civil wording, this kind of custody has an exceptional character. However, the different regional laws and the jurisprudence in this matter consider joint custody as the most beneficial measure for the interest of the child. The present study will focus on the evolution of joint custody in Spain, both in the legislative and jurisprudential, defining what are the advantages and disadvantages of this measure. |
